The anticipation almost feels like the night before Christmas, except there are no presents, and you are not my parents and I’m not 9 years old any more. I started my first business DJConnection.com out of my college dorm room while attending Oral Roberts University. I funded the business by always having 3 jobs while attending college.

Our show is like Steve Martin meets Steve Forbes. You will laugh and learn as you gain the skills needed to earn more than just enough to pay your bills. Now to get things started on a light note, let’s first by talking about the things that will get your fired.

What does the name Elephant In The Room Mean?

An Elephant In The Room is something that everybody sees, but that is never talked about, it’s something that begs the question that nobody asks, it causes one to pause and wonder when somebody is going to fix that broken window or when somebody is going to call that person out for their odd behavior. As it relates to The Elephant In The Room Men’s Grooming Lounge, The Elephant In The Room stands for:

Elephant In The Room #1 – The consistency of wonderful men who have bad haircuts.

This epidemic must be stopped. As a society for the greater good of the planet we must move beyond the mullets, the skullets, and the bowl cut. We must work together the chop the mangy mops that should be stopped. We must work as a team to tame the bangs that make other men say dang. We must remove the look that men choose that causes them to lose. We must trim up that yetty hair that says “I don’t care.”

Elephant In The Room #2 – The Real Elephant In Room – America’s Youth Need Our Help

At the Elephant In the Room we believe that one of the biggest problems in every city is break-down of the family and the effect it has on young men. To show our support and to help make a difference, with each service that is sold at our lounge we proudly make a donation to a local charity that helps support and mentor fatherless boys.

Vision: Where We Are Going?

  1. “Are we there yet?” is a question that my kids like to ask to ask my while I’m driving until my head explodes. As an entrepreneur, the questions I like to ask myself are, “Where are we going?” and “How can I personally improve?” My personal mission is to mentor millions.
  2. However, as a business our focus is to create a men’s grooming lounge that caters to the modern man who is looking for a fantastic experience and not just a haircut. At Elephant in the Room we are committed to supporting the mentorship of the next generation of men and boys through the It Starts With One program where we donate the $1 we charge for the first haircut to the local boys homes in the communities we serve.

Purpose: The Reason We Are Going There.

During the process of delivering an excellent experience to men on the planet Earth, we will provide solutions to following three “Elephants in the Room” facing our country:

1) The lack of high-quality experience-based grooming service providers for men.

2) The lack of employee development, leadership and empowerment training.

3) The lack of authentic mentorship for America’s young boys and men.

**As an extra bonus purpose – I feel called to help to greatly reduce the number of mullets on the planet. Sorry Billy Ray, but these haircuts tend to cause “Achy Breaky Hearts.”

Expectation #1 – You and I are expected to have a positive attitude in every situation. When we choose to not be happy bad things happen. While working at The Elephant In The Room you will eventually get into an argument with a co-worker and when you do you cannot threaten them with physical force, or imply that you are going to threaten them with physical force. We want to create a safe environment for great employees like you and it’s really hard to give a man a nice “fade” while attempting to dodge the ninja kicks and attempted punches of fellow co-workers.
  2. The Elephant In The Room is a Tobacco free facility. If that doesn’t deter you, then you could try to use the full elongated and actual intended meaning of the word such as:
    1. Shipping high in transit – Although many would argue that the word “s&$%” did not originate as an acronym for “Ship High in Transit”, it does make sense to use when referencing transporting massive shipments of manure to prevent them from becoming waterlogged and releasing explosive methane gas.
    2. Fornication under consent of the king – Although many would argue that the word F&$#  did not originate from when sex was outlawed unless it was permitted explicitly by the king, so that the only people who were allowed to have sex outside of marriage had fornication under consent of the King, it would make sense if this word did mean this and it’s not a good word to say anyway.

The Problem

  1. 80% of the people working in the salon industry are stuck in a rut.
  2. Most people in the hair industry feel like they know everything, and that they are trapped financially because of some vast metaphysical conspiracy, office politics or because of where they are from. However, success is possible for a diligent doer like you. Soon they will discover what you already know. Proverbs 10:4 reads, “Lazy hands make for poverty, but diligent hands bring wealth.” Soon they will discover that Elon Musk (The man behind PayPal, Tesla, SpaceX, and SolarCity) was correct when he said): “Work like hell. I mean you just have to put in 80 to 100 hour weeks every week. This improves the odds of success. If other people are putting in 40 hour work weeks and you’re putting in 100 hour work weeks, then even if you’re doing the same thing you know that you will achieve in 4 months what it takes them a year to achieve.”
  3. Soon they will discover that I grew up poor worked at Target, Applebee’s and DirecTV simultaneously 7 days per week to start my first business DJConnection.com.  
  4. Most people in the industry jump from shop to shop believing that if the salon they worked at had a better location, more traffic, more advertising and better people then they would be happy.
  5. Most stylists have a job (Just Over Broke), which is getting them nowhere quickly.

  • S-Specific – The problem most people have with goal setting is that they are setting goals that are too vague and general to do you and I any good. Having a specific goal keeps your attention and energy focused. If your goals are too vague, you will not know exactly where to direct your efforts.

  • M-Measurable – By making your goals measurable and tracking your results you are able to keep score and to determine whether you are improving or not. You must utilize the daily tracking systems we have in place if you are going to make progress. And yes, it does take extra time to keep track. If success were easy everyone would be successful. So how long do you have to track? You only need to keep tracking your numbers forever or as long you want to keep improving.

The Commitment:

3 Steps You Must Take To Get You From Point A To Point B

 

  • 1. Write down your goals – In order for you to be motivated to move you have to know where you want to go. Elephant in the Room is just a vehicle to get you from point A to point B in your life. We can’t help you get from point A to point B if you don’t know where point A or point B is.
  1. Goals are like magnets they pull you towards progress.
  2. Goals force you to become more focused, more disciplined, more creative and more confident.
  • 2. Take a leap of faith – You have to take a blind leap of faith to believe without question the ideas that you don’t yet understand. If “they don’t work” you can always go back to the sea of mediocrity where the other 80% are waiting for you.
  • 3. Postpone judgment for six months – According to Gallup, “70% of People Hate Their Jobs” and according to the Federal Reserve the average American has less than $500 saved. With these statistics being what they are, there is a strong chance that you know exactly what you are doing and that you are already on your path to riches. However, for “other people” there is a 70% chance that they are not going to ever get ahead if they keep doing what they are doing. When “they” start working at Elephant In The Room I would highly recommend that “they” (not you) would blindly buy into the systems and processes for the six months before evaluating as to whether you are happy with your job and the systems we have used at The Elephant In The Room to build it into the company it is today.
  • 4. You must commit to tracking your results – Each day you must track your results. You cannot improve anything you cannot see and you cannot manage anything you cannot measure.

There is no competition when our own minimum standard is higher than the maximum expectations of most hair salons

  • 1. How you feel and what you say doesn’t matter it’s what you do – You must have an unconditional willingness to do what needs to be done whether you feel like it or not. The IDFLID, I Don’t Feel Like It Days come for everyone, but only weak people let their feelings dictate their actions.

  • 2. Never negative on the floor – Talking about negative, dirty, off-color, offensive, political, or racist things while on the floor is simply unacceptable. Don’t ever tell any co-worker how you feel unless it’s “great.”
  • 3. You must implement our processes and systems each and every time with each and every client. Failure to use your client checklist will result in you not being paid for the service you rendered.

Dress Code:

Dress For Success

We strive to give a clean professional image while presenting a uniformed look without requiring you to wear actual uniforms. We do this by adhering to the following dress code.

Required:

All items must be presentable, no tears, stains or odors and wrinkle free.

  1. Hair styled – No one will respect you as being an authority on personally grooming and style if you don’t look the part. You can’t be a chain smoking Pastor, a dentist with oral hygiene problems, a personal trainer who is not in shape or a financial planner who has the habit of not saving money.

Shirts:

  1. Collared Shirts or the official Elephant In The Room t-shirts must be worn at all times.
  2. Colors permitted include: Black or grey and combinations are accepted.
  3. You may choose from a black or grey shirt with collar, black or grey dress up shirt with collar (long or short sleeve), a black or grey pullover sweater and any company shirts are acceptable.
  4. No more than one button is allowed to be unbuttoned at the top.
  5. We do not allow our female employees to show cleavage. For our male employees who want to show cleavage, we don’t allow that either.

Pants:

  1. Must be denim
  2. Colors permitted include: Black, grey and indigo (dark blue)
  3. Belt – As we grow we don’t want to be the brand known for sagging pants and for unintentionally showing off our derrieres.

  1. Colors permitted include: Black or grey, shoe trim must be white or neutral (tan or brown)
  2. Shoe requirements – Shoe options that are allowed include: Dress shoes, Slip-ons, black boots and fashion sneakers are allowed example: vans, toms, polo’s, etc.

Tip Policy:

  1. All tips must be added to your paycheck so that the proper taxable amounts will be withheld and paid to our friends at the government. In addition credit card fees will be withheld from all tips paid via credit card.
  2. All cash tips must go through Front Desk and are to be recorded on tip sheet (however we are a cash free shop).
  3. Grooming Professionals will receive their cash tips at closing or the following business day.

Damaged Equipment:

  1. You are responsible for maintaining the working order of all of your equipment and your actual workstation.
  2. You will be charged 100% of the replacement costs for all equipment that disappears or is reported as missing.
  3. You will be charged 100% of the replacement costs for all equipment that is damaged due to carelessness or accidental breakage.
  4. If you damage your lightsaber you will have to repair it yourself (they are expensive and rumor has it that the cost has just gone up again).
  5. If you damage your bicycle while biking on a non-work related bike trip you are 100% responsible for the repair fees paid to the bike shop.

Additional Employment Policies

SICK DAYS & TIME OFF

At the Elephant In The Room, our goal is to make sure that we can offer both employees and customers alike a stable and dependable men’s grooming lounge environment. In order to provide a standard of excellence and consistency we have established the following time off policy.

Time Off Policy:

Yearly Employee Time Off:

  • All employees are allowed 7 unpaid vacation days per year.

Request Time Off Steps:

  • Step 1: As an employee you must submit your time off request form to your direct Manager.
  • Step 2: Your Manager must sign off on your request acknowledging that your requested time off has been received.
  • Step 3: Your Manager will then respond to your time off request within 7 days time to inform you as to whether your requested time off was granted or not.
  • Step 4: Manager approves and makes a copy for employee file.
  • Step 5: Manager returns the approved form and returns it to employee.
  • If you are requesting time off with less than 6 weeks notice, you must notify your manager before or after shift.
  • Employees may not take off both the day before the holiday and the day after the holiday off simultaneously.
  • Managers and Assistant Managers are expected to not take extended vacations during the holidays.
  • Employees are required to call Managers 24 hours ahead to request time off.
  • Failure to call your manager 24 hours prior to your scheduled start time will result in an unexcused absence regardless if you have a doctor’s note or not.
  • Employees must have doctor’s note for sick days off.
  • Sending a text message to a Manager is not an acceptable means of communication. You must speak with your Manager over the phone.

Scheduling Out Policy

  1. You are required to be at work, punched in and ready to see customers 15 minutes before the start of your scheduled shift. You will be considered late if you punch in after your scheduled start time. Makeup and hair must be done before you clock in.
  2. Employee will be paid for assigned 15-minute breaks.
  3. Employees must clock out during lunch (and will not be paid for their lunch breaks).
  4. Employees who work a 5 hour shift or less will not be given a break.
  5. Employees who work 5 to 6 hours shall be assigned a 15-minute break.
  6. Employees who work 6 to 7 hours shall be assigned a 45-minute lunch break.
  7. Employees who work open to close shall be assigned a 45-minute lunch break and a 15-minute break.
  8. The Assistant Manager or Manager on Duty for each Elephant In The Room location shall assign break times.
  9. The Assistant Manager or the Manager for each Elephant In The Room location shall assign and stagger lunch times.
  10. We want to be able to give you a lunch break at an ideal time whenever possible. Based on our client volume we will give our best effort to give you a lunch between the hours of 11 AM – 3 PM. However, if circumstances arise where we get an influx of clients we will at times need to push your lunch break outside that window.
  11. Managers and Assistant Managers cannot leave during normal open store hours unless there is another manager present.
  12. Managers and Assistant Managers can break for a 10-minute personal break throughout the day as needed. The assumption is that Elephant In The Room can trust the judgment of a Manager not to leave their post during the workday, unless they truly have a pressing need.
  13. Management will determine on a case-by-case basis any absence that would be considered an emergency and not require the 24 hour advance call to the Manager.

Employee On-Time / Late Policy:

  1. Arriving at work fully-dressed 15 minutes before your shift is considered “on-time.”

Employee Discounts Program:

  1. Male Elephant In The Room employees may get their haircut for 70% off of the normal pricing and the haircuts must be scheduled through the call center.

Phone Policy:

  1. Cell phones, smartphones, rotary dial phones, or phones of any type must not be brought into the Elephant In The Room by grooming professionals.
  2. In case of emergency you can always be reached through the store Manager.

Customer Privacy Policy:

  1. Client Data Privacy: All client information is private and confidential and is not to be used for personal gain.

Computer Policy:

  1. No electronics, tablets, personal computers or other devices allowed in your personal workstation or shop.

Food Policy:

  1. Food is to be eaten in designated areas, not on the floor or where services are performed.

Write Up Policy:

  1. An employee who violates the rules of the shop, or who willingly demonstrates insubordinate behavior will have each incident documented by their manager.
  2. The manager will then talk to the employee who is demonstrating the insubordinate behavior in an attempt to correct the behavior.
  3. Manager will file documentation at the shop location where the incident occurred.

DRUG AND ALCOHOL FREE WORKPLACE POLICY

Elephant in the Room Policies strive to provide a safe work environment and encourage personal health. In keeping with this policy, the company considers the abuse of drugs or alcohol on the job to be an unsafe and a counterproductive work practice. It is, therefore, company policy that an employee detected to have alcohol or illegal drugs in his/her system or possession of, using, selling, trading, or offering for sale illegal drugs or alcohol during work hours, will be subject to disciplinary action including discharge. (Company sponsored activities which may include the service of alcoholic beverages are not included in this provision. Discretion should be exercised by the employee to avoid overindulging in the consumption of alcohol.) Substance Abuse includes possession, use, purchase, or sale of drugs or alcohol on company premises (including parking lots).

Are you allowed to drink at a company party if alcohol is provided by the company? ______________________

Employees will be required to submit to drug and/or alcohol testing at a laboratory chosen by the company for the following reasons:

    1. Observed alcohol or drug abuse during work hours on company premises.
    2. Apparent physical state of impairment.
    3. Incoherent mental state.
    4. Babbling about “flat Earth theories” while engaging in unsanctioned finger paintings while using someone else’s fingers.
    5. Accident or other actions that provide reasonable cause to believe the employee may be under the influence.
    6. The employee has an ankle bracelet that keeps vibrating while they are filling up their red Solo cup with Jamaican Rum Punch in the bathroom between haircuts.
    7. As required by any government programs such as the US Department of Transportation.

In addition to testing for the purposes above, Elephant In The Room reserves the right to randomly test employees. Refusal to such testing will subject an employee to disciplinary action up to and including termination of employment.

ANTI-HARASSMENT POLICY

Elephant In The Room has a zero tolerance for and therefore prohibits all forms of illegal harassment of employees by managers, fellow employees, and employees of contractors and/or visitors including any demeaning, insulting, embarrassing or intimidating behavior directed at any employee because of their sex, race, age, nationality, religion or disability.

Sexual harassment is defined as unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when (1) submission to such conduct is made, either explicitly or implicitly, a term or condition of an individual’s employment, (2) submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual, or (3) such conduct has the purpose or effect of substantially interfering with an individual’s work performance or creating an intimidating, hostile, or offensive working environment.

Sexual harassment can take two distinct forms: quid pro quo and hostile work environment.

    1. Quid pro quo harassment occurs when submission to sexual conduct is made a condition of employment or employment benefits.
    2. Hostile work environment occurs when sexual conduct unreasonably interferes with an employee’s work performance or creates an intimidating, abusive, or offensive work environment.

Sexual harassment includes verbal harassment, such as epithets, derogatory comments, or slurs; physical harassment, such as assault, impeding or blocking movement, or any physical interference with normal work movement and visual harassment, such as derogatory posters, cartoons, or drawings.

Elephant In The Room will take incidents of alleged sexual harassment seriously, with follow-up investigation and appropriate corrective action if necessary.

REPORTING PROCEDURE

Any individual who believes he/she is subject to sexual harassment, or believes sexual harassment may be taking place whether or not it directly affects that individual, must report the circumstances as soon as possible to any one of the following: immediate Supervisor, Human Resources Administrator, Officer of the Company, or any person designated in the Employee Handbook as a Contact Person. Upon completion of any investigation, Elephant In The Room will take appropriate action.

ADA and ADAA POLICY

Elephant In The Room is committed to complying fully with the Americans Disabilities Act (ADA) and ensuring equal opportunity in employment for qualified persons with disabilities. All employment practices and activities are conducted on a non-discriminatory basis.

REQUESTING AN ACCOMMODATION

PAYROLL DEDUCTIONS

The following mandatory deductions will be made from every employee’s gross wages: federal income tax, Social Security FICA tax, and applicable city and state taxes.

3% credit card processing fees and payroll taxes are deducted from these payments appropriately.

Every employee must fill out and sign a federal withholding allowance certificate, IRS Form W-4, on or before his or her first day on the job. This form must be completed in accordance with federal regulations.

The employee may fill out a new W-4 at any time when his or her circumstances change. Employees who paid no federal income tax for the preceding year and who expect to pay no income tax for the current year may fill out an Exemption form Withholding Certificate, IRS Form W-4E. Employees are expected to comply with the instructions on Form W-4. Questions regarding the propriety of claimed deductions may be referred to the IRS in certain circumstances.

What does the IRS stand for? ________________________________

Other optional deductions include the portion of group health insurance not paid by the company, which is deducted from each payroll check. Other voluntary contributions, such as credit union and pension plans, are also deducted each pay period. Any other deductions from pay require your voluntary, written and specific authorization to do so.

Your tips that are processed through Elephant In The Room are reported on your paycheck and taxes are deducted from these payments appropriately. These tips are considered part of your salary income.

Acknowledgement

I have received my copy of the Elephant in the Room Policies that outlines the policies, practices, and guidelines of the company, and I have read and I understand the information contained in the manual.

Since the information in these policies is subject to change as situations warrant, it is understood that changes in the manual may supersede, revise, or eliminate one or more of the policies in these policies. These changes will be communicated to me by my supervisor/manager or through official notices. I accept responsibility for keeping informed of these changes.

I further acknowledge my understanding that my employment with Elephant in the Room Policies is considered at will and may be terminated at any time with or without cause. Only official executed, legally binding contracts of employment supersede employment at will.

CONFIDENTIALITY AGREEMENT

This Confidentiality Agreement (the “Agreement”) is made effective as of the date set forth on the signature page hereto by and between Elephant in the Room, INC., an Oklahoma corporation (“Elephant In The Room”) and the undersigned employee (“Employee”).  

Employee is or will become an employee of Elephant In The Room (the “Employment”).  During the course of the Employment, Employee will receive certain confidential, proprietary information related to Elephant In The Room, its operations, the franchised Elephant In The Room businesses (“ELEPHANT IN THE ROOM Businesses”), and/or the proprietary methods for establishing, operating, and promoting ELEPHANT IN THE ROOM Businesses (the “Licensed Methods”).  Elephant In The Room is willing to proceed with the Employment as long as Employee is willing to maintain the confidentiality of this proprietary information as follows:

AGREEMENT

  1. At-Will Employment; Consideration.  This Agreement does not affect Employee’s employment status as an “at-will” employee, meaning either Elephant In The Room or Employee may terminate the Employment with Elephant In The Room with or without cause at any time, except as prohibited by law or as provided in a separate written agreement between Elephant In The Room and Employee.  Employee acknowledges that the offer of Employment or continued Employment is adequate and sufficient consideration for the terms and conditions of this Agreement. Employee further acknowledges that he or she was advised prior to Employment of the requirement to sign an agreement containing the terms set forth in this Agreement.

2.Confidential Information.  

  1. Employee recognizes that much of the information provided to Employee by Elephant In The Room, and developed by Employee during the course of the Employment, will be confidential and proprietary information of Elephant In The Room (“Confidential Information”), constitute trade secrets of Elephant In The Room, and will remain the sole and exclusive property of Elephant In The Room.  For purposes of this Agreement, the Confidential Information includes, but is not limited to all proprietary information concerning ELEPHANT IN THE ROOM Businesses; the Licensed Methods; all financial information of Elephant In The Room or its franchisees other than financial information filed with any government regulatory agency; marketing methods; sales and promotional methods; all nonpublic statistical information; the strategic plan, budgets and projections for Elephant In The Room; all information concerning negotiations of any kind conducted by Elephant In The Room whether pending or completed; all marketing research data and marketing plans; all information contained in the Elephant In The Room operations manuals, and any other manual or other nonpublic written information; internal lists of franchisees and customers of ELEPHANT IN THE ROOM Businesses; and all other information which may be considered a trade secret or proprietary and such Confidential Information as may be further developed from time to time by Elephant In The Room.

 

  1. Employee shall at all times, during and after the term of Employment, keep secret and retain in the strictest confidence, all Confidential Information, and not use for personal gain or disclose the Confidential Information to anyone outside of Elephant In The Room; except for disclosure of information in the normal and proper performance of Employee’s duties and in accordance with instructions by Employee’s supervisor, or with Elephant In The Room’s prior written consent.
  2. Employee must promptly deliver to Elephant In The Room upon the expiration or termination of the Employment for any reason whatsoever, or at any time that Elephant In The Room so requests, all memoranda, notes, records, reports, manuals, and other documents (and all copies of them) constituting Confidential Information or otherwise relating to any of Elephant In The Room’s business Employee possesses or controls.
  3. Employee will not, either during or after the term of Employment, use or seek to use any of the Confidential Information for Employee’s own benefit, for the benefit of a competitor of Elephant In The Room or any ELEPHANT IN THE ROOM Business, or to benefit any other person or entity in any way adverse to the interests of Elephant In The Room or any ELEPHANT IN THE ROOM Business.
  4. Inventions.  All inventions, discoveries, developments, methods and processes, including written materials and know-how related thereto, whether or not patentable, copyrightable, or constituting trade secrets, conceived, made, or discovered by Employee (whether alone or with others) through use of the Confidential Information, the Licensed Methods, or otherwise in connection with the Employment (the “Inventions”) will be owned in their entirety by Elephant In The Room and considered part of the “Confidential Information.”

To the extent that any Invention comes within the definition of a “work made for hire” under the U.S. Copyright Act of 1976, such material will be considered a “work made for hire” owned by Elephant In The Room and Elephant In The Room will be deemed to be the author of such material.  

To the extent that any Invention cannot for any reason be considered a “work made for hire,” Employee hereby assigns and transfers exclusively to Elephant In The Room all of Employee’s right, title, and interest in and to the Invention, including but not limited to claims to copyrights therein and to any derivative or moral rights relating thereto.  Employee acknowledges that Elephant In The Room will be free to utilize the Inventions in its sole discretion. If requested by Elephant In The Room, Employee will execute and deliver to Elephant In The Room all additional instruments or documents deemed necessary or desirable by Elephant In The Room in its sole discretion, to vest in Elephant In The Room all right, title and interest in and to any such Inventions.

  1. No Interference.  Employee covenants and agrees that, for a period of one year after conclusion, expiration, or other termination of the Employment, neither Employee, nor any member of Employee’s immediate family, shall interfere with the business of Elephant In The Room by interfering with or disrupting, or attempting to interfere with or disrupt, the relationship, contractual or otherwise, between Elephant In The Room and any of its existing or prospective franchisees, customers, suppliers, partners or joint ventures.
  2. No Diversion of Employees.  Employee covenants and agrees that, for a period of one year after the conclusion, expiration, or other termination of the Employment, neither Employee, nor any member of Employee’s immediate family, shall divert or attempt to divert the employment of any employee or other representative of Elephant In The Room, to any employment, consultation, or other position outside of Elephant In The Room by direct inducement or otherwise.
  3. Injunction.  Employee acknowledges and agrees that in the event of any breach or threatened breach of this Agreement, Elephant In The Room shall be authorized and entitled to seek from any court of competent jurisdiction preliminary and permanent injunctive relief in addition to any other rights or remedies to which it may be entitled.
  4. Miscellaneous. The waiver by Employee or Elephant In The Room of a breach of any provision of this Agreement shall not operate or be construed as a waiver of any subsequent breach thereof.  This instrument contains the entire agreement of Employee and Elephant In The Room relating to the matters set forth herein. It may not be changed orally, but only by an agreement in writing, signed by both parties.  Elephant In The Room may assign all or part of this Agreement and the rights, which inure to it hereunder without the consent of Employee.

This Agreement shall not be assignable by Employee.  The prevailing party in any suit or action arising out of or related to this Agreement will be entitled to recover from the other party its attorney fees, costs and expenses in the amount that the court determines reasonable in both the trial court and appellate courts (as applicable). This Agreement shall be governed by and construed under the laws of the State of Oklahoma, U.S.A.  The invalidity or unenforceability of any provision of this Agreement shall in no way affect the validity or enforceability of any other provision.

  1. Employee Non-Compete Agreement.
